EB-5 Holding Escrow
The Immigrant Investor Program, also known as “EB-5,” was created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. This program enables foreign investors to obtain permanent residency status in the U.S. for themselves and their families by making a qualifying investment in a project that creates jobs in the local economy.
Many EB-5 investment projects utilize the services of an escrow holder to coordinate the foreign investment transaction and to provide an added measure of security and peace of mind for their investor clients. In a typical transaction, the Regional Center or affiliated project will establish an escrow account for each investor-applicant. The investor transfers the investment funds into the escrow account, and upon notice from USCIS, the investment funds are disbursed to the Regional Center or affiliated project in accordance with the escrow instructions.
